6. Linking to the Site

You may provide links to the Site, provided that you do not remove or obscure, by framing or otherwise, any portion of the homepage, and you discontinue providing links to the Site if requested by us.

7. Limitation of Liability

(a) We and any Affiliated Party shall not be liable for any loss, injury, claim, liability, or damage of any kind resulting in any way from (i) any errors in or omissions from the Site or any services or products obtainable therefrom, (ii) the unavailability or interruption of the Site or any features thereof, (iii) your use of the Site, (iv) the content contained on the Site, or (v) any delay or failure in performance beyond the control of a Covered Party.

(b) THE AGGREGATE LIABILITY OF US AND ANY AFFILIATED PARTY IN CONNECTION WITH ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE AND/OR THE PRODUCTS, INFORMATION, DOCUMENTS, AND SERVICES PROVIDED HEREIN OR HEREBY SHALL NOT EXCEED $100 AND THAT AMOUNT SHALL BE IN LIEU OF ALL OTHER REMEDIES WHICH YOU MAY HAVE AGAINST US AND ANY AFFILIATED PARTY.


8. Privacy Policy

Our Privacy Policy, as it may change from time to time, is a part of this Agreement. By using the Site, you agree to be bound by the terms of our Privacy Policy.

9. Indemnification

You agree to indemnify, defend, and hold us and our partners, employees, and affiliates harmless from any liability, loss, claim, and expense, including reasonable attorney's fees, related to your violation of this Agreement or use of the Site.

10. Severability

If any provision of this Agreement is determined by a court of competent jurisdiction to be unenforceable, such provision shall be severed and the remaining provisions of this Agreement shall remain in full force and effect.

11. Termination

We may terminate this Agreement at any time, with or without notice, for any reason. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in USA, Minnesota.

13. Changes to Terms of Use

We reserve the right to change these terms at any time. Updated versions of the terms will appear on this Site and are effective immediately. You are responsible for regularly reviewing the terms. Continued use of the Site after any such changes constitutes your consent to such changes.
